Regularisation of Foreign Nationals in Spain: LATEST UPDATES
If you are in an irregular administrative situation in Spain, you may be eligible for the foreign nationals’ regularisation process, provided you meet the requirements set out in this Extraordinary Regularisation scheme, which is currently in the draft stage, pending approval by the Council of Ministers and publication in the Official State Gazette (BOE).
General Requirements
You must have arrived in Spain before 1 January 2025.
You must prove that you have been in Spain for at least five months at the time of application.
You must have no criminal or police record.
Not pose a threat to public order, security or public health.
Not be barred from entering Spain nor be subject to a return commitment.
Have paid the relevant fee.
In addition, you must be in one of the following situations:
- Have worked in Spain or have a job offer.
- Be living with your family unit in Spain.
- Be in a situation of proven vulnerability.
Entry and residence requirements in Spain
Under the general regularisation scheme, you must have entered Spain before 1 January 2025.
In the specific case of asylum seekers, you must have submitted your asylum application before 1 January 2026, provided you meet all other requirements.
Effects of the Application
Once your application has been accepted for processing, you may reside and work on a provisional basis until a decision is reached on your case.
If your application is successful, you will be granted a one-year residence permit, which may be extended or amended at a later date.
The deadline for submitting applications is 30 June 2026.
Important: You will not be eligible for this regularisation if you already hold a residence or stay permit.
Situation of Minor Children
You may apply for a permit for them as a minor born or not born in Spain.
Requirements such as length of stay, financial means and housing report are removed.
Family Members
Parents, spouse or registered partner may be included in the regularisation process.
Changes to the Immigration Regulations
Work will be permitted from the moment the application is accepted for processing in cases of social and labour ties.
The authorisation will only take effect once the applicant has registered with Social Security within one month.
Asylum seekers
They must have applied for asylum before 1 January 2026.
They must meet all other general requirements.
Authorisation will be granted for one year for the applicant and up to five years for their children.

Applications may be submitted in person, by appointment, only at authorised immigration offices. They may also be submitted online by an authorised legal representative.
