Synopsis of the Regularisation of Immigrants in Spain (2026)

1. Applicant profile

Regularisation is aimed at foreign nationals who were already living in Spain illegally.

Applicants must have arrived before 31 December 2025 and have no serious criminal record or entry bans.

2. Proof of residence in Spain

Applicants must demonstrate a minimum continuous stay of 5 months prior to the application.

Documents such as registration with the local council, medical reports, official appointments, certificates from NGOs or any other verifiable evidence are acceptable.

3. Basic documentation

  • Passport (even if expired)
  • Proof of residence in Spain
  • Criminal record certificate (if requested)
  • Official forms and payment of fees

It is not necessary to present an employment contract.

4. Submission of the application

The application must be submitted to the Foreigners' Office within the official deadline (spring 2026), either in person or online, depending on the autonomous community.

5. Situation during processing

While the application is being processed:

  • No expulsions are carried out.
  • The person is administratively protected.
  • The Administration reviews and verifies the information.

6. Granting of the permit

If the decision is favourable, a residence and work permit is granted for one year, valid for employed or self-employed work, with access to healthcare and labour rights.

7. After the first year

The permit can be renewed and counts towards future options for long-term residence or nationality, as applicable.

  • Asylum seekers prior to 31/12/2025
  • Minors and family units
  • Persons with demonstrable social ties

Summary:

This process allows the legal situation of people already living in Spain to be regularised, facilitating their social and labour integration.

The Decree-Law announced by the Spanish Government has not yet been published. All the information provided is based on statements made by the Government Spokesperson, which is expected to be published during February 2026.
